These Terms of Service govern your use of the Dermatology & Plastic Surgery of Arizona online storefront and your purchase of products, gift cards, treatments, and services.
Throughout these Terms, “DPSAZ,” “we,” “us,” and “our” refer to Dermatology & Plastic Surgery of Arizona. By accessing the storefront or completing a purchase, you agree to these Terms.
Storefront Purpose
The DPSAZ storefront provides access to eligible retail products, gift cards, prepaid treatments, services, packages, and promotional offers. Temporary events, including Gratitude Savings Week, may have additional terms, exclusions, purchase limits, or redemption requirements. If an offer has separate promotional terms, those terms apply in addition to these Terms of Service.
Eligibility and Account Information
You must be at least 18 years old or have the involvement and permission of a parent or legal guardian to make a purchase.
You agree to provide current, complete, and accurate information during checkout. You are responsible for reviewing your selected product, service, location, contact information, and order total before submitting payment.
Products and Services
We make reasonable efforts to present accurate descriptions, images, pricing, and availability. Product packaging, appearance, ingredients, and specifications may change without notice. Images are provided for general reference and may not precisely reflect the product received.
Service descriptions are educational and do not guarantee that a treatment is appropriate for you or that a specific result will be achieved.
Medical Services and Clinical Approval
An online purchase does not establish a provider-patient relationship, constitute medical advice, or confirm eligibility for treatment.
Treatments and services may require consultation, medical history review, examination, consent forms, and provider approval before they can be performed. DPSAZ may decline, postpone, or modify a treatment when clinically appropriate or necessary for patient safety.
Individual treatment results, recovery experiences, and the number of treatments needed vary.
The storefront should not be used for emergencies or urgent medical concerns. Call 911 or seek immediate medical assistance in an emergency.
Orders and Payment
Submitting an order is an offer to purchase. DPSAZ may accept, decline, or cancel an order because of inventory limitations, pricing errors, suspected fraud, technical issues, eligibility restrictions, or other reasonable circumstances.
If DPSAZ cancels an order after payment has been processed, the affected amount will be returned to the original payment method.
Prices are listed in U.S. dollars. Applicable taxes and fees will be displayed during checkout. Payment must be successfully processed before an order is completed.
Pickup and Location Selection
Orders are available for pickup only unless otherwise expressly stated.
Customers must select the correct Tucson or Sierra Vista storefront when purchasing. Inventory is maintained separately for each office. Products purchased through one location may not be available for pickup at the other, and transfers are not guaranteed.
The person picking up an order may be asked to provide identification, the order confirmation, or proof of authorization.
Scheduling and Redemption
Treatments and services must be scheduled separately after purchase. Purchasing a service does not reserve an appointment time.
Availability varies by provider, treatment, and office. Service purchases must be redeemed according to any terms, eligibility requirements, deadlines, or exclusions displayed with the offer.
Gift Cards
Gift cards may be used only for eligible purchases from Dermatology & Plastic Surgery of Arizona. They are not redeemable for cash except where required by law. Lost, stolen, or unauthorized gift cards may not be replaced without satisfactory proof of purchase.
Additional terms displayed with a gift card are incorporated into these Terms.
Promotions
Promotions may be limited by date, office, product, service, provider, quantity, or customer. Promotional offers cannot be combined unless expressly stated.
DPSAZ may correct, modify, suspend, or cancel a promotion when necessary because of an error, misuse, technical problem, inventory issue, or other circumstances affecting the offer’s proper operation. Completed purchases remain subject to applicable law.
Final Sale Policy
All sales are final. Returns, exchanges, cancellations, and refunds are governed by the DPSAZ Return Policy, which is incorporated into these Terms.
Acceptable Use
You may not use the storefront to:
Violate any law or regulation
Submit false, misleading, or fraudulent information
Interfere with the storefront’s operation or security
Attempt to access another person’s account or information
Copy or exploit storefront content without authorization
Resell products or promotional services without written permission
Intellectual Property
The storefront and its text, graphics, logos, photographs, design elements, and other content are owned by or licensed to DPSAZ and are protected by applicable intellectual-property laws. Content may not be reproduced, distributed, or used commercially without written permission.
Third-Party Services
The storefront may rely on third-party providers for hosting, payments, analytics, communications, and related services. DPSAZ is not responsible for separate websites or services operated by third parties. Your use of those services may also be subject to their terms and privacy notices.
Disclaimer
To the fullest extent permitted by law, the storefront and its content are provided on an “as available” basis. DPSAZ does not warrant that the storefront will always be uninterrupted, error-free, or free from harmful components.
Nothing on the storefront replaces individualized advice from a qualified healthcare professional.
Limitation of Liability
To the fullest extent permitted by applicable law, DPSAZ will not be liable for indirect, incidental, special, or consequential damages arising from use of the storefront.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute will be handled in a court of competent jurisdiction unless the parties agree to another lawful resolution process.
Changes to These Terms
We may update these Terms periodically. The revised Terms will be posted with a new effective date. Your continued use of the storefront after an update constitutes acceptance of the revised Terms.
